ABSTRACT

This chapter addresses the role of Convention 108+, a legally binding international instrument for data protection, in strengthening responses to the challenges posed by increasing digitalisation and the globalisation of data flows. The modernised Convention strengthens the rights of individuals and the obligations of controllers, while maintaining a technologically neutral approach that is legally compatible with other regulatory frameworks, representing a new asset for international organisations. Their contribution to the work on modernising the Convention has enabled us to adapt the provisions to sensitive operational contexts, while ensuring a high level of protection. The work to revise the Convention culminates in the accession of an international organisation to it.
