ABSTRACT

This chapter discusses the working of the ne bis in idem principle at the intersection of the enforcement of competition rules and public procurement law. It focuses on the operation of this principle in fining proceedings against managers of companies involved in bid rigging. It discusses various versions of the concurrent legal liability for bid rigging. This chapter also analyzes the legal institutions designed to eliminate liability duplication. It also covers the Polish case law. It finally provides several potential solutions to the problem of the duplication of legal liability of natural persons for bid rigging.
