ABSTRACT

The fourth chapter seeks to answer the question posed in the book's title: Is there a fundamental revolution or gradual evolution in the use of AI in international commercial arbitration? To address this issue, the chapter primarily analyzes the principles that should guide the use of AI-powered tools: human oversight, transparency, confidentiality, and ethical considerations. The chapter also examines how to strike a balance between the challenges and benefits of using AI-powered tools in international arbitration. This “golden mean” can be achieved through AI disclosure, the absence of a “black box” dilemma, and the introduction of specialized multi-agent AI tools and human-AI hybrid models, which allow for the optimal implementation of AI-based tools under human oversight. The analysis concludes that we are facing an evolutionary process in which AI tools are increasingly implemented in dispute resolution mechanisms. Against this backdrop, international commercial arbitration keeps pace with technological advancements. In this context, many innovation-driven technologies are setting a new standard in international arbitration.
