ABSTRACT
This chapter explores the current legal status of hydrogen within the framework of European law, seeking to identify hydrogen as a key element in the European energy transition. Focusing on the existing legal provisions, the discussion examines where the law of the European Union (EU) explicitly addresses hydrogen and its derivatives, providing a comprehensive overview of relevant regulations and directives.
Through a legal mapping exercise, the chapter situates hydrogen within the current legal landscape, setting the stage for deeper analyses in subsequent chapters. It seeks to answer the critical question of the status quo for hydrogen in EU law, evaluating how existing legal instruments align with the goals of a sustainable and decarbonised energy system.
By situating hydrogen within the broader context of European law, this chapter lays a foundational understanding of the legal mechanisms that could either support or hinder the development of a robust hydrogen economy. It emphasises the importance of recognising hydrogen's potential role in achieving the EU's climate objectives, while also identifying areas for legislative enhancement to facilitate its integration into the energy market.
