ABSTRACT
In civil proceedings, the parties’ will is expressed through the legal claim, which initiates the proceedings, defines its object, and limits the judge’s power. Even in constitutive protection, the party’s will to effect change is particularly effective, although it must be implemented through a judicial decision.
