Omissive Fraud During Negotiations From The Perspective Of Contractual Liability

The essay analyses the problem of malicious silence during pre-contractual negotiations, the consequences it can have on the contract concluded, and the remedies available to the deceived party. After briefly reconstructing the problem in Western legal tradition and Italian law, the research focuses on projects for the harmonization of European contract law to find a solution aimed at protecting the victim of deception.
