ABSTRACT

Chapter 3 examines the most prominent aspect of the inter-judicial dialogue between the International Court of Justice and municipal courts as it addresses the reception of the jurisprudence of the former in decisions of the latter. Instances of such reception were identified in 224 domestic judicial decisions originating from 37 different jurisdictions, 6 continents, and issued by 103 courts. Again, the vast majority of those rulings was rendered after the year 2000. They predominantly referred to ICJ pronouncements as authoritative evidence of international legal norms, but were also consulted for treaty interpretation purposes, provided guidance in the field of internal law sources, or assisted in fact determination. Finally, the chapter attempts to discuss the status of ICJ decisions in municipal legal orders as perceived by judicial institutions in their few decisions.
