ABSTRACT

This chapter examines the protection of human rights and fundamental freedoms (human rights). In particular, it examines the constitutional basis for the protection of human rights by analysing some key features of the constitutional provisions on human rights. It then turns its focus to the National Commission on Human Rights and Freedoms and the Department for Human Rights in the Ministry of Justice. In doing so, the chapter elucidates on the role of those two institutions in the protection of human rights and comments on their weaknesses and prospects for success. This chapter complements discussions in Chapters 4 and 5 relating to the protection of human rights by the judiciary and the Constitutional Council.
