ABSTRACT

For more than a decade after the 1989 Revolution, companies could not be held criminally responsible in Romania. The 1997 Criminal Code (law no. 65 of 16 April 1997) did not allow it. In June 2004, however, a new Criminal Code was introduced, which established corporate criminal liability. The new Code came into effect a year later. In July 2006, some amendments were made, which are relevant for establishing criminal liability for companies (see below).1
