ABSTRACT

This chapter discusses the safety “fitness” of the employer. The issue at hand is the ability of the motor carrier to handle all aspects of transportation in a safe manner. Each motor carrier is responsible for ensuring that all drivers employed by them are properly licensed with commercial driver’s licenses (CDLs). The CDL must be the only driver’s license that a driver holds, and it must be active. This regulation satisfies the most fundamental of all of the requirements for a safety fitness rating—safety. Motor carriers are responsible for ensuring that they maintain an adequate amount of financial responsibility if an accident or some other type of property damage occurs. The employer must conduct a road test that will allow drivers to demonstrate their ability to safely operate the commercial motor vehicles they will be driving.
