The contract sets out the intentions of the client and the supplier, any dispute arise the true meaning of the roles and responsibilities of both sides is clear. This chapter compares bespoke and standard forms of contract and describes some of the standard forms available. Bespoke contracts are written specifically to suit the circumstances of the relationship they are to control. The alternative to bespoke contracts is standard forms of contract. Standard forms of contract are available in the majority of industries and their use is to be preferred over a bespoke form. By using standard forms, clients are demonstrating that they wish to abide by industry standards and not impose unfair terms that shift the balance of power too much in their favour. Standard forms are produced within a range of industries typically by professional bodies serving those industries or by committees specifically set up for the purpose.
