All leases and tenancies will tend to state the names of each party, the duration of the term, describe the premises, and set out the obligations of the parties. This chapter looks at more detail at the structure of a commercial lease. The Land Registration Rules 2005 (SI 2005/1982) provide that registrable commercial leases dated on or after 19 June 2006 must contain prescribed clauses. In some leases, the detail of the covenants may be found in a Schedule, but where the case there will be a clause in the operative part of the lease stating that the tenant/landlord covenants are to comply with the covenants set out in Schedule 1. There are a number of remedies available to landlords and tenants where the other party is in breach. These include the common law remedy of damages and the equitable remedies of specific performance and injunction.
