ABSTRACT
A tribunal which has found that the claimant was unfairly dismissed must ask him whether he wishes to be reinstated or re-engaged.
Reinstatement means that the employee is fully restored to his former position as if he had not been dismissed, for example, arrears of pay, pay rises, seniority are all restored.
