ABSTRACT

It is easy to overlook the obvious fact that the Internet is a global medium which means that a website is available for view from anywhere in the world. In many instances the music business may not really be targeting their merchandise or services at jurisdictions across the globe. They might wish to limit their online activity to the UK only. A number of websites operated by record companies are tailored for a given geographical territory. However it is also common for music websites to make available merchandise or services to international visitors to the site. At first view it might not appear obvious why we have to consider questions of legal jurisdiction in the context of online music distribution. As will be seen, it is however vital for any music company contemplating commercial Internet activity to appreciate the impact jurisdiction will have on its business.
